OPENING:    

 

The regular meeting of the Board of Defiance County Commissioners was called to order at 8:30 a.m. on Thursday, January 24, 2002, in the Conference Room of the Board of Defiance County Commissioners, 500 Court Street, Suite A, Defiance, Ohio  43512 by Chairman Otto L. Nicely.

8:30 a.m.        General Session

 

Commissioners signed Defiance County Landfill’s Fee Pay-In Report for December, 2001.  In-District waste received was 5,557.95 tons.  Out-of-District waste received was 338.55 tons and Out-of-State waste received was 46.37 tons.  The total amount due to the District for December, 2001 is $6,327.79.  These monthly fees are collected on behalf of the Four County Solid Waste Management District.

 

Commissioner Miller left at approximately 9:10 a.m. to attend a CCAO meeting in Columbus.

 

At 9:20 a.m., Kim Bates of the Toledo Blade stopped in to talk to the Commissioners regarding the proposed plans to the Courthouse.  Commissioner Kime reviewed what information and plans the County has and explained that not only has no target date been set for completion, no decisions regarding construction/restoration will be made until input is received from County residents.     

 

9:30 a.m. – Becky Wagner, County Operations Manager/Administrator, presented her weekly report at this time.  She, Mark Hopper, Public Safety Services Coordinator and Marge McCurdy, Maintenance Supervisor will meet on the 29th of January to review the building inspection reports and make punch lists of items to be completed.  She also reviewed the departmental reports received during the monthly staff meeting, held Wednesday.  

 

 

 

 

Mrs. Wagner also informed the Commissioners of a meeting at the Erie County Commissioners office regarding public landfills.  The meeting is being held February 1 at 11:00 a.m.  All three Commissioners plan on attending, along with Tim Houck, Landfill Manager.

 

10:30 a.m. – Paulding County Commissioners, Maurice Wannemacher and Tony Burkley met with the Defiance County Commissioners Otto Nicely and Tom Kime and Jeff Strausbaugh and Russ Herman, Defiance County Prosecuting Attorneys office, to discuss options and ideas in handling the legal aspects of the joint Auglaize River Sewer project.  Sherry Carnahan, Deputy Clerk, came in for the meeting to remain updated on the project.   The Defiance County Prosecutor and the Paulding County Prosecutor will perform the legal work for this project.  Jeff Strausbaugh felt that, as this project was not established as a separate entity, each County’s prosecutor could handle the legal work.  If any bonding becomes necessary, bond counsel would be obtained.

 

Paulding had hoped to create their own sub-sewer district and not need to attach to Defiance’s sewer.  Separating the billing and handling O and M would be a problem if separate districts are not established. 

 

Mr. Strausbaugh felt the Commissioners need to get a little more specific in their joint agreement – he will prepare a letter of intent/memorandum of understanding denoting what each entity will accomplish.  

 

Poggemeyer Design Group’s original engineering agreement and the addendum were reviewed.  It was noted that Rural Development requires separate contracts from each County – that is why both Defiance and Paulding received contracts.  Defiance will remain as fiscal agent for the project. 

 

Mr. Strausbaugh requested each County make a list of items and submit them to their respective prosecutors and request clarification.  The County is currently running under one contract from Poggemeyer; the engineering firm now wishes to submit another contract showing an increase in engineering services.

 

Commissioner Wannemacher feels the Counties have a good working relationship.  Commissioners will contact Lee Sonnenberg, Rural Development, for clarification on easement issues.  Defiance has names of individuals who can perform any necessary appraisals. 

 

Separate agreement on engineering – review addendum and request information from Poggemeyer as to what specific engineering work was completed for which the project was billed.  

 

Mr. Strausbaugh suggested the Counties formalize the agreement between them, then set a meeting with Paulding, Defiance and Poggemeyer for an update.

 

11:15 a.m.      Commissioners Kime and Nicely of Defiance and Wannemacher and Burkley of Paulding met with Phil Marinaro, Workforce Development, to review information to be presented to the Policy Board on Monday, January 28th at noon.
