OPENING:    

 

The regular meeting of the Board of Defiance County Commissioners was called to order at 8:00 a.m. on Monday, February 11, 2002, in the Conference Room of the Board of Defiance County Commissioners, 500 Court Street, Suite A, Defiance, Ohio  43512 by Chairman Otto L. Nicely.

C.                OPEN ISSUES/DISCUSSION

 

Commissioners received a check from the Ohio Department of Natural Resources, Division of Real Estate and Land Management in the amount of $38,083.05 that represents Ohio’s participation and contribution for the NatureWorks Project entity “Ney Park”.  The funds will be used for lighting. 

 

Last Thursday, Commissioners attended a seminar in Toledo hosted by the Ohio Bureau of Workers’ Compensation.  By attending this meeting, Counties would receive a 25% discount on Workers’ Comp fees.  Upon completion of the meeting and conference, Commissioners were informed that they would receive approximately $39,000 from BWC for attending the 4-hour training session.

 

On Friday, Commissioners attended a meeting in Columbus at the Ohio Water Development Authority office.  Agencies present at the meeting were: the Ohio Water Development Authority, the Ohio EPA – Water Pollution Control Loan Fund, Drinking Water and Surface Water divisions, USDA Rural Development, Fifth Third Securities, Ohio Rural Development Co-op, Ohio Department of Development and the Governor’s Regional Representative.  Commissioners from Paulding and Defiance Counties made a presentation to the various agencies requesting assistance and direction as to where additional grant funding might be obtained for the Auglaize Sewer Project.   As a result of Friday’s meeting, total grant funds received will be an additional $1,000,000 and an additional $1,200,000 in low-interest loans for the project.

D.        APPOINTMENTS

 

8:00 a.m.        Russ Herman, County Assistant Prosecuting Attorney, met with the Commissioners to review various documents pending opinions and/or approval. John Ferland, representing the Airport Authority Board, was in attendance to go over the Airport

 

 

 

Rules and Regulations document that Mr. Herman had reviewed.  John will make the requested corrections and resubmit the document for a final review. 

 

8:30 a.m.        General Session

 

9:00 a.m.        Bob Arend, County Computer Consultant, met with the Commissioners in EXECUTIVE SESSION regarding Personnel and Pending Litigation.

Bob was authorized to work with Senior Services Center regarding their computers.  He will also continue working with the TDC Group regarding the County’s GIS software.

Gaylon also submitted his recommendations for bids received for Crushed Aggregate and Bituminous Materials.  The aggregate bids will be awarded to each bidder with the

 

 

understanding that the Engineer will acquire material determined to be most appropriate on a project-by-project basis.

Mr. Davis also noted that the Flickinger Road Bridge Project is progressing very well, due to the good weather.  Also, his office began negotiations on their union contract last week.

 

10:00 a.m. – Otto Gerdeman and Ken Maag, Poggemeyer Design Group, met with the Commissioners for a bid opening for the Express Sewer Project.  Bids were received from the following:

After the bid opening was completed, Mr. Gerdeman reviewed information regarding the Auglaize River Sewer Project and the Sanitary Engineering contract.   

 

11:00 a.m.      Jerry Hayes, Defiance County Economic Development Director, had scheduled this time to meet with the Commissioners to get their approval for two Enterprise Zone Agreements.  The first was for Agri-Lube, Inc. and the second for Defiance Precision Products.  However, Mr. Hayes had not yet received all completed paperwork so the approval and signing of these documents will be postponed to a later date.

 

At 11:30 a.m., Commissioners went into EXECUTIVE SESSION regarding the Purchase and/or Sale of Property

1:25 p.m.        Russ Herman, Defiance County Assistant Prosecuting Attorney, met again with the Commissioners, first to review the upcoming Masterson Annexation continuation (he was not with the County at the time of the initial public hearing) and to review the County’s

Personnel Manual.  Also during this time, Merlin Butler, Poggemeyer Design Group, stopped in and requested EXECUTIVE SESSION for the Purchase and/or Sale of Property.

 

Motion to enter EXECUTIVE SESSION – Tom                Second – Otto           Darrell entered the meeting at 1:28 p.m.

 

EXECUTIVE SESSION ended at 1:50 p.m.

 

Mr. Herman noted that Tim Hutchinson, Prosecuting Attorney’s office, will be handling the annexation process and he will schedule a meeting to review any issues with the Commissioners before the annexation continuation date of February 25th.

 

Mr. Herman has reviewed the Personnel Manual and will submit his recommendations shortly. 

 

At 1:55 p.m., Commissioners entered EXECUTIVE SESSION regarding Pending Litigation.

Jeff Strausbaugh, Prosecuting Attorney, joined the EXECUTIVE SESSION at 2:01 p.m.

Kim Moss, Health Department Commissioner, entered EXECUTIVE SESSION at 2:44 p.m.

 

 

 

Commissioner Miller left the session at 2:55 p.m.

 

 

 

EXECUTIVE SESSION ended at 3:15 p.m.
