OPENING:
The regular meeting of the Board of Defiance County Commissioners was called to order at 8:00 a.m. on Monday, February 25, 2002, in the Conference Room of the Board of Defiance County Commissioners, 500 Court Street, Suite A, Defiance, Ohio 43512 by Chairman Otto L. Nicely.

Due to computer problems, the minutes of the February 25 meeting were not ready for approval.

8:00 a.m. Jeff Strausbaugh and Russ Herman, Defiance County Prosecuting Attorney’s Office, met with the Commissioners under EXECUTIVE SESSION regarding Imminent Litigation. Motion – Tom Second – Otto (Darrell arrived at 8:06 a.m.) This EXECUTIVE SESSION ended at 8:14 a.m.
Commissioners then requested EXECUTIVE SESSION regarding Discipline of Personnel at 8:15 a.m.

8:30 a.m. General Session
9:00 a.m. – Jerry Overmier, Beilharz Architects, met with the Commissioners to show small scale color drawings of the proposed renovations/additions to the County Courthouse.
Commissioners reviewed the drawings and asked several questions about the structure. Mr. Overmier will put the drawings on disk so a PowerPoint presentation can be made available for possible future presentations. Also, he will have additional copies of the drawings made for various organizations and/or display. Pricing for the renovation of the courthouse is complete; Mr. Overmier will have the addition pricing estimate for the Commissioners some time next week.
9:30 a.m. Gaylon Davis, Defiance County Engineer, met with the Commissioners for a brief update. He presented two bridge reconstruction plans for approval – Rosedale Road Bridge, north of Route 249 and Flickinger Road Bridge, south of State Route 15. Both bridges will be done by force account. Mr. Davis also noted that the Highway Garage’s union contract is close to being completed. He should have a contract ready for signatures by next week.
10:00 a.m. – The Masterson Annexation continuation convened at this time. Present at the hearing were George Masterson, Petitioner; John Weaner, Agent for the Petitioner; Roger Reese, Dave Williams and Jeff Leonard, City of Defiance; Jerry Hayes, Defiance County Economic Development Director, Jim Kile, Otto Meyer and Bruce Colwell, Richland Township Trustees; Ted Penner, Attorney for Richland Township and Todd Helberg, Crescent-News. Commissioner Kime reviewed the reasons Ted Penner had given when requesting the continuation: the County had not yet received the City’s ordinance approving the annexation; a question arose regarding the size of the annexation and there was concern that the City would not supply utilities to the annexed area in a timely manner. The Commissioners responded to the questions with information received from the Prosecuting Attorney’s office. There being no outright prohibition to the annexation, Commissioners Nicely called for a motion.

1:30 p.m. Jim Harris, Soil and Water Conservation District Administrator, met with the Commissioners to open bids for the Dwight Ditch Project #97-14. Bids were received from the following:

Shininger Surface Drainage $5,481.00
Ney, Ohio
David Head Excavating $4,400.00
Paulding, Ohio
Rosengarten Construction $4,205.00
Ottawa, Ohio
Engineer’s estimate is $4,985.00

After the bid opening, Mr. Harris answered several questions from the Commissioners regarding surface water/drainage.
2:00 p.m. Diane Mayer, Tina Hiler and Paul Gaeke, Defiance County Senior Services Center, met with the Commissioners with an update. They reviewed the parameters and funding allotment of the Caregiver’s Grant. The Senior Services Center submitted a budget showing how funds will be utilized. Also, a part-time computer teacher will be contracted to educate and/or answer questions for seniors through this grant. Caregiver Grant funding totals $84,018.00 with the Senior Services Center contributing $4,800.00.
2:30 p.m. Marlene Goodwin, County Auditor, and Jill Little and Barb Lasek, Deputy Auditors, met with the Commissioners with a request for a transfer of funds. They are requesting a total of $101,651.53 be transferred from Unappropriated to Salaries ($10,000), PERS ($1,500) and Contract Services ($90,151.53) in the Real Estate Fund line. The money will be used for anticipated additional expenses.

Marlene also handed out information regarding the pending legislation of HB 500, which requires state and county offices to send a notice to property owners that permits them to opt out of publication, before the offices publish photographs of the owner’s homes or businesses on the Internet, and to prescribe the form of that notice.
3:00 p.m. Russ Herman, Assistant Prosecuting Attorney, met again with the Commissioners to review the list of documents pending approval at his office as there was no opportunity to review these items at the 8:00 a.m. session. During this time Commissioners approved:
Cooperative Agreement for Construction, Maintenance and Operation of State Sanitary Sewer Project Between Ohio Water Development Authority and Defiance County Commissioners
