12-19-2006 MEETING

LOCATION: VFW Post 3360 – Defiance, Ohio


TIME:             6:30 P.M.


Meeting was called to order by Mr.  Lynn Keller,  Chairman of the Defiance Township Zoning Bd of Appeals.   Mr.  Keller asked the clerk to call the roll.   


The Clerk then called the roll for attendance.  Board of Appeals members present were:  Lynn Keller,  Bruce Hahn,  Ruth Ann Schofield & Rodell Behlke.   There being four of five members answering the roll as present a quorum was declared.


Other Township representatives present were:  Mr.  James Schlegel – Township Zoning Inspector, Mr. Robert Layne,  Mr. Dan Peck, & Mr. Richard Ankney – Township Trustees. 


Visitors present were:  Chris Fisher – 533 Jadine Driver,  Tom Mick – 21389 Hammersmith road,  & JoEllen Houck of 8 Deville Drive,  Defiance,  Ohio.   


Chairman Keller then read item 1 of the agenda: 


Item 1:             Request for a “conditional Use” permit has been made by Chris Fisher of 533 Jadine Drive,  Defiance,  Ohio,  43512  to use an existing agricultural zoned parcel of 11.72 acres more or less for residential use for the purpose of constructing a new home.  The parcel is located on the north side of Powers Road, .5 miles east of Krouse road in the southwest quarter of the southwest quarter of section 32 of Defiance Township, Defiance County, Ohio.  The parcel ID is  B11-0032-0-004-03. 


a.      The clerked was acknowledged and noted that a packet of information which contained a copy of the application for a “conditional use” permit, & a property review performed by the Defiance County Soil & Water group which included an aerial photo of the property. 


b.      Mr.  Keller then asked Mr.  Fisher to review his request for the Board.


c.       Mr.  Fisher stated it was his intention to construct a home on the property.


d.      Mr.  Keller then asked if Mr. Schlegel, Twp Zoning Inspector had any concerns with the request.  Mr.  Schlegel stated he had no objection to the request.  Schlegel also said he issued a “conditional use permit” for the construction of a pond.  The proposed site for the pond had not been reviewed by Soil & Water. 


a.      Mr. Keller stated that Mr. Fisher should have “Soil and Water” review the proposed site for the pond to make sure all set backs were met. 

b.      Fisher stated he would get this review.


i.      Mr. Keller then said he would be willing to move on the “conditional use permit” if there was a motion from the Board. 


Mr. Hahn moved to approve the issuance of a “conditional use permit”  to build a house and pond if all set backs were met. 


Mr.  Behlke seconded.


The clerk called the roll.

The motion to approve the “conditional use permit”  was approved.


The Chair asked if there was any other business to come before the Board. 

There being no further business to come before the Board of Appeals Mr.  Keller requested a motion to adjourn the meeting.
