DEFIANCE TOWNSHIP ZONING COMMISSION

12-19-06 MEETING

 

DATE:            Tuesday,  December 19,  2006

 

LOCATION: VFW Post 3360 – Defiance, Ohio

                       

TIME:             7:00 P.M.

 

The Defiance Township Zoning Commission meeting was called to order by the Chair – Mr.  Richard Wagner. The Chair instructed the clerk to called the roll.  Answering as present were:  Zoning Commission members Richard Wagner - chair,  Randy Wilde, Wayne Schaffer and Paul Zipfel.   There being four of five members present a quorum was declared. 

 

Other Township representatives present were:  Mr.  James Schlegel – Township Zoning Inspector,  Mr. Robert Layne,   Mr.  Dan Peck &  Mr. Richard Ankney – Township Trustees, & Township Zoning Board of Appeals member:  Ruth Ann Schofield.  

 

Visitors present:   Jerry Baden - 21234 Powers Rd, Rick Baden – 21374 Powers Road,  & JoEllen Houck of 8 Deville Drive,  Defiance,  Ohio.   

 

Chairman Wagner instructed the visitors to sign in on the sing in sheet needed for the minutes of the session.

 

The chair then asked for and questions or comments pro or con to item #1 on the agenda.

 

Item 1:             Request of Jerry Baden of 21234 Powers Road,  Defiance,  Ohio,  43512  to rezone a parcel of land from agricultural to residential.  The parcel is ten (10) acres more or less and is located on Powers Road.  Said parcel of land being in the Southeast quarter of the Southwest quarter of  Section 33 – parcel ID B11-0033-0-002-03 in Defiance Township, Defiance County, Ohio. 

Information distributed includes:

 

a.   copy of application for re-zoning –

b.   Defiance County Soil & Water review report with an aerial photo

c.   A letter from Defiance County Planning Commission recommending approval of the zoning request change.

a)         The Commission per procedure reviewed the proposal at its monthly (December)  meeting and provided comment to the Zoning Commission.

 

1)   Mr.  Schlegel – Twp Zoning Inspector, asked for clarification relative to the property to be re-zoned, asking if the parcel was two five acre lots or one ten acre lot.

a)   Mr.  Baden noted that the parcel is per the County Auditor’s records presently one 10 acre unit.

 

2)   There were no further comments offered.

 

3)   Chairman Wagner after hearing all comments requested a motion for the approval or denial of the request.

 

           

MOTION:   Mr.  Wilde   moved to approve

                                                     

             SECOND:   Mr.  Schaffer

The motion to recommend to the Trustees the rezoning from Agriculture to Residential – r-1passed. 

 

 

There being no further business to come before the Defiance Township Zoning Commission Mr.  Wagner requested a motion to adjourn the meeting.
