DEFIANCE TOWNSHIP ZONING BOARD OF APPEALS

09-26-2006 MEETING

 

DATE:            Tuesday,  September 26th,  2006

 

LOCATION:  VFW Post 3360 – Defiance, Ohio

                       

TIME:             6:30 P.M.

 

Meeting was called to order by Mr.  Lynn Keller,  Chairman of the Defiance Township Zoning Bd of Appeals.   Mr.  Keller asked the clerk to call the roll.   

 

The Clerk then called the roll for attendance.  Board of Appeals members present were:  Lynn Keller,  Rodell Behlke,  & alternate Marvin Scott.   There being two of five members & one alternate participating in the session a quorum was declared.

 

Other Township representatives present were:  Mr.  James Schlegel – Township Zoning Inspector, Mr. Robert Layne,  Mr. Dan Peck,  & Mr. Richard Ankney – Township Trustees. 

 

Visitors present:   John & Jennifer Bok 12017 Ashwood Rd., Jeff Mick 21389 Hammersmith Rd,  & JoEllen Houck of 8 Deville Drive,  Defiance,  Ohio.   

 

Chairman Keller then read item 1 of the agenda: 

 

Item 1:             Request of   John Bok 21389 Hammersmith Rd,  Defiance,  Ohio,  43512.  Bok seeks a  “conditional use” permit.  A request has been made to erect/construct a new home on property located at 12017 Ashwood Rd.,  Defiance,  Ohio.  Said parcel is part of the northwest quarter (1/4) of section 31,  Township 4 North, Range 4 East in Defiance Township, Defiance, County.   The parcel is one and one-half (1.5) acres more or less and is located on the east side of Ashwood Road.  Said property being in parcel ID B110031000100 in Defiance Township, Defiance County, Ohio.

a.      Mr.  Keller noted that the Board members were provided the following information:

i. An application for a “conditional use”  permit to build a home

ii. a property review performed by the Defiance County Soil & Water group.  This review included an aerial photo of the property; & a 

iii.      legal description

 

b.      Mr.  Keller asked if anyone had any questions or concerns with this request. 

iv.      There were none.

 

c.       Chairman Keller requested a motion for the approval/disapproval of the request.

 

Mr.  Behlke moved to approve the request for a “conditional use” permit to build a home on this parcel.

 

Mr.  Scott seconded the motion.

The motion to approve the issuance of a “conditional use” permit to build a home on the parcel was approved. 

 

Mr.  Keller then read the second item on the agenda:

 

Item 2:     Request of  George Schroeder 20202 Powers Rd.  Defiance,  Ohio,  43512.  Schroeder seeks a “conditional use” permit.  A request has been made to erect/construct a new home on property located on the east side of Krouse Rd approximately ¼ mile south of Powers.  Said parcel is part of the west half of the northwest quarter of section 5, township 3 north, range 4 east, Defiance Township, Defiance, County, Ohio.  The parcel is five (5) acres more or less.  Said property being in parcel ID B110005000503 in Defiance Township, Defiance County, Ohio.

 

1.       Mr,  Keller noted that the following items were provided to the Board members for their review:

a.   A copy of application for conditional use permit –

b.   a Soil & Water review

c.   a plat survey

d.   a field drawing, &

e.   a partial release of mortgage & assignment of rents notice

 

2.      Mr.  Keller asked if anyone had any questions or concerns with this request.

f.    Zoning Inspector Schlegel was recognized and stated that the home to be constructed was 1120 sq feet and that all set back requirements were met.

 

3.      Chairman Keller requested a motion for the approval/disapproval of the request.

 

Mr.  Behlke moved to approve the request for a “conditional use” permit to build a home on this parcel.

 

Mr.  Scott seconded the motion.

The motion to approve the issuance of a “conditional use” permit to build a home on the parcel was approved. 

 

The Chair asked if there was any other business to come before the Board. 

There being no further business to come before the Board of Appeals Mr.  Keller requested a motion to adjourn the meeting.
