Meeting was called
to order by Mr. Lynn Keller,
Chairman of the Defiance Township Zoning Bd of Appeals.
Mr. Keller asked the clerk to call the
roll.
The Clerk then
called the roll for attendance. Board of
Appeals members present were: Lynn Keller,
Bruce Hahn, Thomas Rosendale & alternate Robert Williamson.
With three of five members and an alternate answering present a quorum was
declared.
Other Township
representatives present were: Mr.
James Schlegel – Township Zoning Inspector, Mr. Dan Peck,
Mr. Richard Ankney & Mr. Charles Bakle – Township Trustees.
Visitors present

Chairman Keller then
read item 1 of the agenda:
Item 1:
A
request for a “conditional Use” permit had been made by Ciccotelli Design Ltd,
1036 Schultz Street, Defiance,
Ohio, 43512
to use an existing agricultural zoned parcel of 5 acres more or less for the
construction of a Church. The parcel is
located on the south side of Watson Rd, approximately
.1 miles west of State Route 15. The parcel
is part of the N.E. Quarter of section 12 in Defiance Township, Defiance County, Ohio.
The parcel ID is B110012000104.
a.
Mr. Keller noted that a packet of
information which contained a copy of the application for the “conditional use”
permit, and data on the proposed project
supplied by Defiance County Soil & Water had been provided by the clerk to all Zoning
Bd Appeals members.
b.
Mr. Keller then asked if anyone wished
to comment on this proposal.
a.
Mr. Gary Walker was recognized and
said he was representing the delegation from the Jehovah Witness Church.
Mr. Walker said his church was buying
the property from Ciccotelli Design Ltd of Defiance for the purpose of constructing a
church.
i.
Mr. Walker also said they were working
a company that builds church buildings and this company has provided all information as
requested to Defiance County Soil & Water for their review which resulted in the
report Soil & Water has provided to the Appeals Board members.
b.
Mrs. Ruth Ann Schofield was recognized and she asked if the church group had been
in contact with Defiance County Engineer’s office for access needs and if they had been
in contact with the Health Department for sewer needs.
i.
Mr. Walker said that they had.
c.
Carl Wagner (lives across the road from the proposed church construction site) was
recognized and noted that recently the Church contractors-builders were surveying and were
on his property. He wanted the church
representatives to know that they should seek permission before coming onto his property.
i.
Mr. Walker apologized for this and
said that in the future they would seek permission if any other work on this project
required that they be on any one’s property other then their own.
d.
Dan Hart (a neighboring property owner) asked if OEPA had approved the sewer –
septic system for the church.
i.
Mr. Walker said they had. Walker also
said that if and when the Ayersville Water and Sewer system was available to the church
the church would hook up to this service.
e.
Mr. Bruce Wiesenburger (a neighboring property owner) asked when construction was
to begin.
i.
Mr. Walker said this summer or very
early fall.
f.
Mr. Keller after noting that if the
“conditional user permit” were to be approved there were other approvals that the
church will need to acquire. The church
should get in contact with the County Engineer’s Office, Twp Zoning Inspector and the Defiance County Planning Commission.
i.
Keller then asked if there were any other concerns or questions.

There were none.
Chairman Keller
requested a motion for the approval/disapproval of the request.
Mr.
Hahn moved to approve the requested “conditional use”
permit to allow for the construction of the church.
Mr. Williamson seconded.

The vote being four
yea’s and no nea’s - the motion to approve the “conditional use permit”
was approved.
The Chair asked if
there was any other business to come before the Board.

Keller requested a motion to adjourn the meeting.
