COUNTY COMMISSIONERS
THURSDAY, AUGUST 29, 2013
The
Board of Defiance County Commissioners met in regular session at 8:30 a.m. on Thursday,
August 29, 2013 in the Conference Room in the Commissioners’ Office at 500
Court Street, Suite A, Defiance, Ohio 43512.
Chairman Otto L. Nicely called the meeting to order. Also present were Commissioners James E. Harris,
Jr. and Thomas L. Kime, Sherry Carnahan, Fiscal Manager/Administrator, and Stephanie
Metz, Clerk.
The
Commissioners met in General Session and approved and signed various
resolutions, contracts and documents. The Commissioners also reviewed the
calendar of events and discussed upcoming meetings.
On Monday, August 26,
2013, the Commissioners’ Office received an Expedited Type 2 Annexation
petition from Troy Essex, Clemens, Kohn, Liming & Warncke, Ltd. The
petition requests 0.918 acres in Noble Township (Section 12) to be annexed into
the City of Defiance. The Clerk will continue to follow the Ohio Revised Code
for the annexation process.
On Tuesday, August 27,
2013, the Commissioners’ Office received an Expedited Type 2 Annexation
petition from Elizabeth Schuller, UAW Legal Services Plan. The petition
requests 1.000 acres in Noble Township (Section 12) to be annexed into the City
of Defiance. The Clerk will continue to follow the Ohio Revised Code for the
annexation process.
On Tuesday, August 27,
2013, the Commissioners’ Office received an Expedited Type 2 Annexation
petition from Stephen Hubbard, Hubbard Law Firm. The petition requests 6.000
acres in Noble Township (Section 11) to be annexed into the City of Defiance.
The Clerk will continue to follow the Ohio Revised Code for the annexation
process.
On Wednesday, August 28,
2013 the Commissioners’ Office received an Expedited Type 2 Annexation petition
from Marc F. Warncke, Clemens, Kohrn, Liming & Warncke, agent for the
petitioners. The petition requests 1.243 acres in Degler Addition in Richland
Township to be annexed into the City of Defiance. The Clerk will proceed with
the annexation process per Ohio Revised Code.
The Commissioners
approved a demolition contract with Sines Excavating, LLC for the demolition of
a residence at 5903 Adams Ridge Road through the Moving Ohio Forward Program.
The Board approved
several matters for the Hillandale Farms Ohio, LLC. development project.
Enterprise
Zone Agreement - Hillandale
Farms Ohio, LLC shall construct a new laying hen complex for egg
production, egg processing and packaging,
truck maintenance and feed production in a multi-building facility on a land parcel to be
owned by the enterprise at 9715 Rosedale
Road, Hicksville, Ohio. The investment in the new facility shall be
approximately Forty One Million Thirty Eight
Thousand Ninety Eight Dollars ($41,038,098). The total investment for this PROJECT by the
Enterprise will be Twenty Two Million Dollars ($22,000,000.00), plus or minus 20%.
The PROJECT will begin by June 2013, and all
aspects of the Phase I of the project will be concluded December, 2014.
Hillandale Farms Ohio, LLC will create sixty
five (65) permanent full-time jobs which will result in approximately One Million Six
Hundred Sixty Eight Thousand One Hundred Forty Dollars ($1,668,144) in annual
payroll for the Enterprise. Defiance
County granted Hillandale Farms
Ohio, LLC a tax exemption pursuant to Section 5709.62, 5709.63, or 5709.632 of the
Ohio Revised Code for real property improvements made at the Hicksville Township
PROJECT site and shall be in the following amounts: 60% with the consent of the Hicksville Exempted
School District and the Four County
Career Center School District Boards of Education, on real property
improvements as part of the PROJECT, for a
period of ten (10) years.
Development
Agreement - Hillandale Farms
Ohio, LLC. will invest $41,186,156 million in Phase 1 of the proposed
Hicksville Egg Production and Processing Facility project site within the
County of Defiance, State of Ohio. The project includes the construction of
eight production barns, the installation of processing and handling equipment,
on-site water wells and manure waste handling and storage facilities, a waste
lagoon, miscellaneous on-site support infrastructure, off-site roadway
improvements, a gas line extension, and electrical service upgrades.
Defiance County shall construct 5,280
linear feet street improvements and associated drainage facilities. Defiance County shall provide $50,000 in CDBG
Funds, $214,000 in ODOT Jobs and Commerce Funds. Hillandale Farms Ohio, LLC
agrees to contribute $166,000 toward the financing of the roadway
improvements. These funds shall be
placed on deposit with the Defiance County Commissioners at the time of signing
this Development Agreement. Defiance County agrees to provide CDBG Funds to
support the construction of 2.85 miles of 4 inch gas main to be extended by the
Ohio Gas Company to the Hillandale Farms Ohio, LLC. project. Defiance County
shall provide $440,000 in CDBG Funds to support the construction of 2.85 miles
of 4 inch gas main and the Ohio Gas Company shall provide $46,000 in equity
funding.
Award
bids for the 2013 Cement Stabilization to Tenmile Creek Excavating, LLC - Due to funding delays, the project could not be
awarded as originally scheduled.
Award bids for the 2013 Rosedale Road Paving to Brooks Construction
Company - Due to
funding delays, the project could not be awarded as originally scheduled.
The
Commissioners will be attending the Defiance County Economic Development’s
Strategic Planning Event at Defiance County East at 5:00 p.m. on Thursday.
The
Commissioners will not have session on Monday, September 2, 2013 due to the
County Offices being closed in observance of Labor Day.
