The Board of Defiance County Commissioners met in regular session at 9:00 a.m. on Monday, September 17, 2018 in the in the Commissioners’ Session Room at 500 Court Street, Defiance, Ohio 43512. President Ryan Mack called the meeting to order.  Also present were Commissioners Mick Pocratsky and Gary Plotts, and Stephanie Metz, Clerk.

 

The Commissioners met in General Session; they approved and signed various resolutions, contracts and documents. The Commissioners also reviewed the calendar of events and discussed upcoming meetings.

 

Warren Schlatter, Defiance County Engineer, met with the Commissioners to provide a weekly update for the Engineer’s Office and the Landfill. Warren reported that the roadside grading work continues on Jericho Road. Work is continuing on Watson Road.

 

Greg Reinhart, Defiance County Wastewater Operations, met with the Commissioners to provide a monthly update.

 

Jerry Hayes, Defiance County Economic Development, met with the Commissioners to provide a monthly update. Jerry reviewed several enterprise zone agreements; there are still items that need to be completed prior to the Commissioners approving them.

 

Russ Herman, Defiance County Prosecuting Attorney’s Office, met with the Commissioners to provide an update on various legal matters.

 

Kevin Hancok, Defiance County Ditch Maintenance, met with the Commissioners for two Ditch Construction Base Review Public Hearings. Ohio Revised Code §6137.11 and §6137.112 provide for a permanent base review of improvements for maintenance fund assessments after six annual maintenance fund assessments have been made. Ohio Revised Code §6137.11 provides for the mechanism to add to the schedule of benefited landowners any other owner who in the judgment of the board is benefited by the operation and maintenance of the improvement as the result of new conditions that have arisen since the improvement was constructed. On August 13, 2018, benefitted landowners of the following ditches were provided notice of the Public Hearing in accordance with the Ohio Revised Code: Brandt Ditch and Kahout Ditch. Public Hearings for all of these were held today, where the Board reviewed and approved the following:

·       The Brandt Ditch is 7,600 feet long and was petitioned in 1969 with a total construction base of $10,478.20. The average annual cost to maintain this improvement over the last six years has been $738.90. The new proposed construction cost, which was figured at the current construction costs, is $17,940.00. It was discovered that two parcels of land should be on the schedule of benefited landowners. The parcels are described as: K14-8000-0-004-00, which is owned by Tiffin Township Trustees, and A07-8000-0-003-00, which is owned by Defiance County Engineer. The new construction cost and benefited landowners were approved.

 

·       The Kahout Ditch is 11,000 feet long and was petitioned in 1992 with a total construction base of $6,531.22. The average annual cost to maintain this improvement over the last six years has been $2,029.06. The new proposed construction cost, which was figured at the current construction costs, is $24,300.00. It was discovered that three parcels of land should be on the schedule of benefited landowners. The parcels are described as: F12-0002-0-002-03, which is owned by Gregory Burket, F12-0002-A-003-00, which is owned by David L. & Ruth Memmer, and F12-0002-A-003-00, which is owned by John Phillips. The new construction cost and benefited landowners were approved.
